Linda Van Coppengahen (“The Artist”) is committed to protecting the personal data of all individuals. This policy describes how the Artist processes data in accordance with the General Data Protection Regulation, 2016 (GDPR) and the new Federal Data Protection Act, 2017 (BDSG-new).
Legal basis for the processing
The artist ensures that personal data is collected and processed on a valid legal basis. For competitions, the explicit consent of participants is obtained and declared online before they submit information. This consent is clearly communicated on the entry forms to ensure that participants understand what they are consenting to.
Transparency
The artist attaches great importance to transparency in her data practices. Participants are provided with clear information about how their data is used, including the specific purposes for which it is collected. This information is easily accessible on the artist’s website and includes details of data processing, storage and disclosure. The Artist will endeavor to disclose the details to an individual to whom this data relates upon request, unless such a request would put the Artist at risk of disclosing trade or business secrets.
Data processing
The personal data collected by the artist is processed for the following purposes:
– Verification of eligibility to participate in a competition.
– Contacting winners and managing prizes for competitions.
– Analysis of participation and involvement in competitions.
– Improving the user experience on the website or obtaining feedback on live events.
– Contacting and tracking the person who submitted their personal information.
– Completion of a sale of an item for tracking and cancellation purposes.
Data processing activities are carried out securely and confidentially and are only accessible to authorized employees who need the information to perform their duties.
Data storage
Personal data is stored securely on servers located in the European Economic Area (EEA). The artist implements robust access controls and regular backups to protect the integrity and confidentiality of the data. Participants’ information will only be retained for as long as necessary to fulfill the purposes of the relevant response. Thereafter, it will be securely deleted in accordance with the data retention policy summarized here.
Data transfer
The artist will not share, sell or disclose the personal data of participants to third parties unless this is necessary to fulfill the purposes of the competition or required by law. In such cases, the Artist will ensure that recipients are bound by confidentiality agreements and adhere to privacy standards equivalent to its own. Where third party service providers are engaged to assist in the administration of competitions or data processing, the artist selects them carefully and binds them contractually to ensure the security and confidentiality of the data. These service providers are obliged not to use the data for other purposes and are subject to feedback monitoring and monitoring of system access.
Earmarking
Personal data is collected exclusively for the data processing purposes stated above. The artist does not use the data for unrelated activities or purposes. Online forms specify the intended use of the data and ensure that individuals are fully informed.
Data minimization
The artist adheres to the principle of data minimization by only collecting information that is necessary for the specific type of engagement. Excessive or irrelevant data is avoided, focusing solely on what is required to facilitate the event, sale or inquiry and enhance the customer experience, whether in person, in a live audience or online.
Accuracy
Measures will be taken to maintain the accuracy of the personal data collected. Participants will have the opportunity to contact the artist to verify and update their information as needed. They are encouraged to inform the artist of any inaccuracies to ensure that records remain current and accurate. The artist will correct any inaccuracies indicated.
Memory limitation and data retention
Although the law does not stipulate a maximum retention period within which the artist may keep personal data, it will only be kept for as long as necessary to fulfill the purposes of the respective event, up to 48 months thereafter or until the data is no longer needed, whichever comes first. After that, it will be securely deleted.
Integrity and confidentiality
Security and access measures are implemented to protect personal data from unauthorized access, loss or breach. The security measures are limited to what the Artist is permitted to do at the software level by the relevant hosting provider. The artist has chosen a reputable hosting provider to reasonably ensure that the data collected is hosted with a company whose employees are trained in data protection best practices and whose security protocols are regularly reviewed to ensure compliance with the GDPR and BDSG-new across the entire IT stack.
Responsibility
The artist commits to accountability in data processing activities. Documentation of compliance measures is retained and listed here, and the Artist is prepared to provide evidence of compliance with data protection laws upon request. This commitment to data protection is an integral part of the operational procedures.
